Host Terms of Service

1. Overview

These Host Terms govern your use of The Wedding Ticket, a service operated by 67 Percent Inc. ("Company," "we," "us," or "our"), to create event pages, manage guest lists, send invitations and event communications, collect RSVPs, and receive monetary contributions from invited guests.

By creating a host account, you agree to these Terms. Our Acceptable Use Policy and Refund and Cancellation Policy are incorporated into these Terms. Our Privacy Policy explains how we collect, use, and share personal information when you use the service.

2. Payment Processing and Non-Custodial Model

Card acceptance, settlement, reserves, and payouts are provided by Stripe, Inc. and its affiliates ("Stripe"). You must agree to Stripe's applicable terms. Contributions are processed and held by Stripe and paid out to you according to a payout schedule we configure with Stripe. Funds are held solely by Stripe in the host's connected account.

The Company does not take possession of funds and does not act as a bank, money transmitter, or escrow agent. The Company's ability to take application fees, facilitate refunds, configure payout schedules, or provide instructions through Stripe Connect is limited to functionality made available through Stripe's platform and does not mean that the Company holds guest funds.

All payouts remain subject to Stripe's risk checks, reserves, disputes, chargebacks, and compliance validations. No payouts are fronted, advanced, or otherwise funded by The Wedding Ticket.

We do not control the timing or availability of host payouts. Those determinations are made by Stripe. As a general matter, payouts are typically available shortly after contributions clear, often within 2 to 7 days, subject to Stripe processing timelines and any risk-based holds or reserves, particularly for new or high-risk accounts.

3. Eligibility and Verification

Hosts must be at least 18 years old, located in the United States, and provide accurate identity, tax, and payout information. Stripe may verify your identity and request additional documents. We and Stripe may decline, suspend, or terminate access for risk or compliance reasons.

4. Creating Events and Setting Contributions

The platform may calculate and display a suggested per-guest contribution amount based on information provided for the event. Where the service permits, you may accept, modify, or set a per-guest contribution amount. The service may also offer additional contribution options, features, or payment choices from time to time. You represent that contributions are voluntary monetary gifts from guests to you in celebration of your event, are not charitable donations, and do not purchase admission, attendance, or entry. You may not condition attendance or access to the event on making a contribution. You will not misrepresent your event or the intended use of funds.

5. Fees

We charge a platform fee per successful contribution as disclosed in your dashboard or at checkout. Stripe charges separate processing fees. Our fee is deducted contemporaneously with processing or at payout.

6. Payouts, Holds, and Reserves

We may instruct Stripe to place reserves, hold payouts, or reverse transactions if fraud, disputes, legal requirements, risk concerns, or policy violations are suspected.

7. Refunds, Cancellations, and Postponements

Refunds, cancellations, and postponements are governed by our Refund and Cancellation Policy. If an event is canceled or materially changed, you authorize us to instruct Stripe to issue refunds in accordance with that Policy and card-network rules. If you do not take required action, we may act to protect contributors.

8. Disputes and Chargebacks

Card disputes are administered by Stripe and the card networks. You agree to cooperate with evidence requests. You are financially responsible for chargebacks and related fees attributable to your event.

9. Acceptable Use and Legal Compliance

You must comply with our Acceptable Use Policy and all applicable laws when using the service. You may not use The Wedding Ticket for unlawful, fraudulent, misleading, abusive, or prohibited activity, or attempt to circumvent security, compliance, consent, payment, or account controls.

When using guest-list or communication features, you may not use purchased, rented, or scraped contact lists; send unrelated commercial or promotional messages; knowingly contact individuals who have opted out; or misuse another person's contact information.

We may suspend, restrict, or terminate access for violations of these Terms or the Acceptable Use Policy.

10. Guest Information and Communications

The service allows you to create and manage a guest list, add or import guest information, allow prospective guests to submit their own information through QR codes or shared links, approve or reject self-add submissions, and send invitations, reminders, and other communications relating to your event. You determine who is included on your guest list and who is invited to your event.

Guest Information

You may enter or import contact information for bona fide event invitees when that information comes from your existing relationship with the guest or from a source reasonably connected to management of the event, such as your spouse or partner, a family member, a wedding planner, or another person assisting with the guest list.

You are responsible for using guest information only for legitimate purposes associated with your event and in accordance with applicable law. You will not knowingly provide materially false guest information or use guest information for an improper purpose.

A guest may also submit information through a QR code, link, invitation, or other self-add feature. Where the service provides an approval function, you are responsible for approving or rejecting submissions based on whether the individual should be included in your event.

Text Messaging

Providing a guest's telephone number to the service does not, by itself, establish that the guest has consented to receive text messages where consent is required. You may not direct, request, or attempt to use the service to send text messages in violation of applicable law or a recipient's communication preferences.

The service may require a guest to affirmatively opt in before text messaging is enabled. You may not bypass, defeat, or circumvent that requirement, and you will not represent that a guest has consented to receive text messages unless you have a reasonable basis for that representation.

Event Communications

Communications sent through the service must relate to the applicable wedding or event, including invitations, save-the-date information, RSVP requests, reminders, schedule changes, venue information, and similar event-related communications. You may not use guest information or the service's communication features to send commercial advertising, unrelated promotions, third-party marketing, or other messages unrelated to the event.

Opt-Outs

Guests may withdraw consent or opt out of certain communications. You will not intentionally use the service to contact a guest through a communication channel after the service indicates that the guest has opted out or withdrawn consent for that channel. You will not re-add, re-import, change, or otherwise manipulate guest information for the purpose of bypassing an opt-out or suppression control.

We may stop communications, suppress contact information, restrict messaging functionality, or suspend or terminate an account if we receive complaints or reasonably believe the service is being used to send unauthorized or unlawful communications.

11. Taxes

Contributions are not charitable donations and are not tax-deductible to contributors. The Company does not provide tax advice. You are responsible for determining the appropriate tax treatment of amounts you receive through the platform and for any reporting and payment obligations that may apply to you.

12. Content and License

You grant us a limited, non-exclusive license to host, process, and display content you upload or submit for your event as necessary to provide the service. You represent that you have all necessary rights to that content.

13. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from third-party claims, demands, losses, liabilities, damages, costs, and reasonable attorneys' fees to the extent caused by:

  1. content or information you knowingly provide through the service without lawful authority to do so;
  2. communications you initiate, direct, or knowingly cause to be sent in violation of applicable law or a recipient's documented opt-out;
  3. your material breach of these Terms;
  4. your fraud, intentional misconduct, or knowing misuse of the service; or
  5. your violation of applicable laws governing your event or your use of the service.

This Section does not require you to indemnify the Company for claims, losses, or liabilities to the extent caused by the Company's own negligence, gross negligence, willful misconduct, violation of applicable law, or material breach of these Terms.

14. Arbitration Agreement and Class Action Waiver

You and the Company agree to resolve any dispute or claim arising out of or relating to these Terms or the service through binding individual arbitration rather than in court. The Federal Arbitration Act and Indiana law govern the interpretation and enforcement of this provision.

The arbitration will be administered by the American Arbitration Association under its Commercial or Consumer Rules as applicable. The seat of arbitration will be Marion County, Indiana. Either party may bring a claim in small claims court instead of arbitration if the claim qualifies. You and the Company each waive any right to a jury trial and to participate in a class action, class arbitration, or representative action.

You may opt out within 30 days of accepting these Terms by sending written notice to 67 Percent Inc., 2106 Morthland Drive #1063, Valparaiso, IN 46383.

15. Termination

You may close your account at any time. We may suspend or terminate access for risk, legal, compliance, or policy reasons. Termination does not relieve you of obligations to address refunds, disputes, chargebacks, or fees.

16. Disclaimers and Limitation of Liability

The service is provided "as is." To the maximum extent permitted by law, we disclaim implied warranties and limit our total liability to the greater of the platform fees you paid to us in the 3 months before the claim or 100 U.S. dollars. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

17. Governing Law and Venue

Indiana law governs these Terms without regard to conflict-of-law principles. For matters not subject to arbitration, the parties consent to exclusive jurisdiction in the state or federal courts located in Marion County, Indiana.
