Guest Terms of Service

1. Overview

These Guest Terms govern your use of The Wedding Ticket, a service operated by 67 Percent Inc. d/b/a "The Wedding Ticket" (the "Company," "we," "us," or "our"), to join an event guest list, provide information relating to an event, receive invitations and event communications, submit an RSVP, and make contributions to an event hosted by a user.

By joining a guest list, submitting information through the service, or making a contribution, you agree to these Terms. Our Acceptable Use Policy and Refund and Cancellation Policy are incorporated into these Terms. Our Privacy Policy explains how we collect, use, and share personal information when you use the service.

2. Nature of Contributions

Contributions are voluntary monetary gifts that support event costs as determined by the host and are considered generally non-refundable personal transfers. Contributions are not charitable donations and are not tax-deductible. We do not provide tax advice.

3. Payment Processing and Non-Custodial Model

Payments are processed by Stripe, Inc. The Company does not hold funds and does not act as a bank, money transmitter, or escrow agent. Stripe, not the Company, processes card payments and handles settlement and related risk controls, subject to Stripe and card-network rules.

4. Pricing and Fees

You will see the contribution amount and any applicable fees before checkout. Processing timelines and statement descriptors are determined by Stripe and your card issuer.

5. Refunds and Cancellations

Refunds and cancellations are governed by our Refund and Cancellation Policy and applicable card-network rules. If an event is canceled or materially changed, we may instruct Stripe to issue refunds consistent with that Policy. Processing times vary by issuer. Refunds may be delayed, restricted, or denied by Stripe if fraud indicators or sanctions concerns are present.

6. Disputes and Chargebacks

If you file a chargeback, Stripe and the card networks will administer the dispute process. Submitting false or abusive disputes is prohibited.

7. Eligibility

You must be at least 18 years old to agree to these Terms on your own behalf or to make a contribution through the service. Information relating to a minor may be submitted by the minor's parent or legal guardian or by another person authorized by the parent or legal guardian.

Contributors must be located in the United States. We may screen contributors against sanctions lists and may instruct Stripe to decline transactions based on risk signals.

8. Your Information

You may be invited to add yourself to an event guest list or provide information through a save-the-date link, QR code, invitation, or other feature of the service. When you submit information through the service, you agree that the information you provide will be accurate to the best of your knowledge.

You may provide information relating to another person only if you are authorized to provide that information for purposes related to the event. For example, you may provide information for a spouse, household member, child, or other person when you have permission or other appropriate authority to do so.

Providing another adult's mobile telephone number does not, by itself, mean that you may consent to text messages on that person's behalf. Unless you have lawful authority to provide such consent, each adult must provide their own consent to receive text messages where consent is required.

Information submitted through the service may be made available to the host of the event for purposes of managing the event, guest list, invitations, RSVPs, and related communications. Our collection, use, and disclosure of personal information are further described in our Privacy Policy.

9. Text Messages and Event Communications

The service may allow you to receive invitations, reminders, RSVP notices, event updates, and other non-marketing communications relating to an event by text message.

If you provide your mobile telephone number and affirmatively choose to receive text messages, you consent to receive event-related text messages at that number as described at the time you provide consent. Providing a telephone number alone does not constitute consent to receive marketing or promotional text messages from The Wedding Ticket, the host, or third parties.

If another person provides your telephone number to the service, that submission alone does not constitute your consent to receive text messages where consent is required. The service may require you to affirmatively opt in before text messaging is enabled.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. Consent to receive text messages is not a condition of making a contribution, using the service, or attending an event.

You may withdraw consent to receive text messages at any time by replying STOP, contacting us at [email protected], or using another reasonable method made available through the service. We will honor opt-out and revocation requests as required by applicable law. Where permitted by law, we may send a one-time message confirming an opt-out request.

If you receive a text message at a number you did not provide or authorize for messaging, you may reply STOP and contact us at [email protected].

10. Acceptable Use

You must comply with our Acceptable Use Policy and may not use the service for unlawful, fraudulent, abusive, or misleading purposes.

You may not impersonate another person, knowingly submit another person's information without authorization, misuse payment information, circumvent guest approval or communication controls, or attempt to override an opt-out or other restriction implemented by the service.

We may restrict or terminate access for violations of these Terms or the Acceptable Use Policy.

11. Responsibility for Intentional Misuse

To the extent permitted by applicable law, you agree to indemnify and hold harmless the Company and its officers, directors, employees, and agents from third-party claims, losses, liabilities, damages, costs, and reasonable attorneys' fees to the extent directly caused by your intentional fraud, knowing impersonation of another person, intentional misuse of the service, or knowing submission of another person's information without authorization.

This Section does not require you to indemnify the Company for claims or losses to the extent caused by the Company's own acts or omissions.

12. Arbitration Agreement and Class Action Waiver

You and the Company agree to binding individual arbitration for disputes or claims arising from or relating to these Terms or the service. The Federal Arbitration Act and Indiana law govern this provision. The American Arbitration Association will administer the arbitration in Marion County, Indiana under its Consumer Arbitration Rules. Either party may bring a claim in small claims court if the claim qualifies. There is no jury trial and no class or representative actions.

You may opt out within 30 days of accepting these Terms by sending written notice to 67 Percent Inc., 2106 Morthland Drive #1063, Valparaiso, IN 46383.

13. Disclaimers and Limitation of Liability

The service is provided "as is." To the fullest extent permitted by applicable law, the Company's total liability to you for any claim arising out of or relating to the service is limited to the greater of the platform fees you paid directly to the Company in connection with the transaction or activity giving rise to the claim or 100 U.S. dollars. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

14. Governing Law and Venue

Indiana law governs these Terms without regard to conflict-of-law principles. For matters not subject to arbitration, any dispute will be heard in the state or federal courts located in Marion County, Indiana.
